ULP essentially failed

With AC being released from the ULP, will they ever face any consequences for their actions with any labour group!
I’m not sure if Jazz intentionally agreed to a pay scale knowing they wouldn’t have to abide by it, which is really the only way I see the ULP having any desired outcome for Jazz pilots.
So, not expecting any decisions in our favour at this point, so what next?
AC pilots seem to think a common employer application is our way of getting on their list, I understand why, since it was tried in the past and more recent discussions have brought that up.
As I see it, arbitration will only include Jazz and when has an arbitration ever forced a company to pony up millions, so if the only way to try and force AC to address the systemic issues that plague Jazz is common employer, what do we really have to lose?
 
Jazz promised flow to a company they can't control. Jazz should have to pay compensation to the affected pilots (all of them are affected in some way). Maybe Jazz management can sue AC for breaching the flow agreement, but that's between management teams at Jazz and AC.

Under the current set up, I believe pay is a pass through cost to AC, so if a grievance was successful, I would think that would be a pass through cost.
The thing is, the ULP was more than the violation of flow, it affected all Jazz pilots and that seems to be overlooked quite often.
Did the pilots eventually flow, yes, did they lose seniority, yes, is it easy to calculate damage, no!
What is easy to calculate is the original reason the ULP was filed, the contract that was supposed to be voted on, it’s a certainty that it would have passed given the inferior one passed. Claude handed Jazz the signed agreement without prejudice and in protest, the ULP was filed the next day!
Rumours about the ULP being completely dismissed are just rumours at this point, nothing official has been released but it is not over by any stretch, next steps will be a common employer filing and likely grievances for the violations. Common employer to challenge the interference from AC and grievances for the flow.
Unfortunately AC always seems to manage escaping from being held to account, hopefully that trend comes to an end sooner than later!
